GDPR, concretely
The documents your procurement review will want:
- A signable Data Processing Agreement, ready to countersign.
- A public, current subprocessor list, no NDA required to see who touches your data.
- An EU data controller: Oh Dear is a Belgian company, subject to GDPR by default, not by adequacy decision.
- Data-subject rights handled from Europe: export, correction and deletion requests answered by the team that runs the service, in your timezone.
Where the checks run from
Uptime monitoring has to check your site from many places, that's the product. Our probe nodes run on AWS, DigitalOcean and Vultr around the world, because your customers are around the world, and a check that only runs from Brussels can't see what a visitor in Singapore sees.
What GDPR governs is where your data is stored and who controls it, and that's Belgium. The checks visit your public site the way any visitor does; the results come home to the EU.
We won't pretend otherwise: probe nodes, backups and check reports run on AWS and DigitalOcean, so we don't claim immunity from the US CLOUD Act. What we can tell you exactly is where your monitoring data lives and who holds it. If a vendor says their global monitoring runs entirely inside the EU, ask what their checks can see from there.
